Gunfire on India-Pakistan border forces hundreds to flee homes



SRINAGAR, India // Fire traded across the Indian and Pakistani border in the remote Kashmir region killed nine people on Monday alone, the highest civilian death toll in a single day in more than a decade, and has forced hundreds of villagers to flee their homes. Overnight, the two countries’ armies again traded heavy mortar fire, leaving seven people injured on the Indian Kashmir side, as villagers fled to shelters for cover, a local official said.

“We had 1,500 people in safe shelters during the night away from their homes along the border,” said Shantmanu, a top administrator of the Indian Kashmir region, who uses only one name.

“It is a voluntary thing. Otherwise the entire border population is vulnerable,” he said, adding that villagers were returning to check on their homes in the morning.

India and Pakistan have accused each other of provoking the exchange of fire, which began on Sunday night and fanned tensions between the nuclear-armed nations that have fought two wars over the Muslim-majority region.

Pakistani officials on Tuesday said Islamabad had lodged a strong protest with the United Nations Military Observers Group over what it said was “unprovoked firing” by Indian troops.

Kashmir is divided between India and Pakistan but both lay claim to the scenic Himalayan region, with regular clashes along their disputed border known as the Line of Control (LoC).

Gun battles in recent days have occurred along the LoC as well as their internationally recognised border further south.

“Seven more civilians were injured last [Monday] night in intermittent small-arms firing in the Arnia area,” top Indian Kashmir police officer Shakeel Beig said.

National home Minister Rajnath Singh, warned that India would “not tolerate such acts of border violations by Pakistan”.

“Ceasefire violation must stop. Pakistan must realise that a decisive government has come to power, which will not take such instances lying down,” Mr Singh said in an interview with the Hindustan Times daily published Tuesday.

India has an estimated 500,000 troops deployed in its part of Kashmir.

India called off peace talks last month over Kashmir after Pakistan consulted with Indian Kashmiri separatists.

Since 1989, fighting between Indian forces and rebels seeking independence or merger of the territory with Pakistan has killed tens of thousands, mostly civilians.

Violence has fallen in the region since 2004 when the countries began a peace process a year after signing a ceasefire agreement that has largely held.

But officials have said the civilian death toll of nine on Monday was the worst in a single day since 2003.

On the Indian side, firing from across the border killed five villagers and left 30 injured. A Pakistani military statement said four civilians, including two children, were killed on its side, while 26 were injured.

The latest exchange of fire comes after a brief period of cooperation in the disputed region between the two foes.

On August 8, Pakistan freed an Indian soldier who was captured after he was swept into the Pakistani zone of Kashmir when his patrol boat capsized.

However, on August 11 both countries again exchanged accusations of cross-border firing while on August 23, Pakistan accused Indian border forces of killing two civilians with their fire.

Commission caps

For life insurance products with a savings component, Peter Hodgins of Clyde & Co said different caps apply to the saving and protection elements:

• For the saving component, a cap of 4.5 per cent of the annualised premium per year (which may not exceed 90 per cent of the annualised premium over the policy term). 

• On the protection component, there is a cap  of 10 per cent of the annualised premium per year (which may not exceed 160 per cent of the annualised premium over the policy term).

• Indemnity commission, the amount of commission that can be advanced to a product salesperson, can be 50 per cent of the annualised premium for the first year or 50 per cent of the total commissions on the policy calculated. 

• The remaining commission after deduction of the indemnity commission is paid equally over the premium payment term.

• For pure protection products, which only offer a life insurance component, the maximum commission will be 10 per cent of the annualised premium multiplied by the length of the policy in years.

Disclosure

Customers must now be provided with a full illustration of the product they are buying to ensure they understand the potential returns on savings products as well as the effects of any charges. There is also a “free-look” period of 30 days, where insurers must provide a full refund if the buyer wishes to cancel the policy.

“The illustration should provide for at least two scenarios to illustrate the performance of the product,” said Mr Hodgins. “All illustrations are required to be signed by the customer.”

Another illustration must outline surrender charges to ensure they understand the costs of exiting a fixed-term product early.

Illustrations must also be kept updatedand insurers must provide information on the top five investment funds available annually, including at least five years' performance data.

“This may be segregated based on the risk appetite of the customer (in which case, the top five funds for each segment must be provided),” said Mr Hodgins.

Product providers must also disclose the ratio of protection benefit to savings benefits. If a protection benefit ratio is less than 10 per cent "the product must carry a warning stating that it has limited or no protection benefit" Mr Hodgins added.
