Can you explain how the end of service gratuity works? I am moving back to Australia at the end of next month after working with my current employer in Dubai for seven-and-a-half years. From what I understand, the gratuity is calculated as 21 days' basic salary for the first five years and 30 days after five, but is the 30 days applicable for every year I have worked? I work for a small company and my boss doesn't seem to know how it works. ML, Abu Dhabi
As set out in Article 132 of UAE Labour Law, the calculation is: “Twenty-one days’ pay for each year of the first five years of service” and “Thirty days’ pay for each additional year. Provided that the entire total remuneration shall not exceed two years’ pay.” To clarify, this means that it is only 30 days for the years in excess of five years of service, calculated pro rata.
